Regulations are scattered across different agencies, each branch reviews claims differently, and the payment calculations through DFAS can be difficult to understand.<br /><br />Along the way I spoke with many other veterans who were facing the same confusion. Some had never applied for CRSC even though they might qualify. Others had been denied and did not understand why.<br /><br />That experience led me to create a new tool designed to help veterans better understand the process.<br />Introducing the Combat Related Special Compensation Guide<br /><br />I recently built and published an AI-powered tool called the Combat Related Special Compensation Guide. The goal of this guide is simple: help veterans better understand CRSC and organize the information needed to pursue a claim.<br /><br />The guide uses a structured interview process that walks veterans through the key information typically reviewed in a CRSC claim. What those documents do not show is what those fourteen years actually took out of me as a person.<br /><span></span>When this started, I was not trying to fight the Navy. I was simply asking for help.<br /><span></span>I had come home from combat deployments in Iraq and Afghanistan carrying things that I did not fully understand yet. Like many service members, I tried to push through it. I believed that if I just worked harder, stayed focused, and kept moving forward, things would eventually get better.<br /><span></span>Eventually the weight of it became too much to carry alone. That is when I asked for help.<br /><span></span>Instead of starting a path toward treatment and recovery, that request set off a process of denials, appeals, and legal battles that lasted more than a decade. What should have been a medical issue turned into a long fight to prove that the injuries I carried home from war were real.<br /><span></span>Over the years I was called a liar. I was labeled a malingerer. At times I was treated like a sub-par sailor who was trying to avoid responsibility. After everything my shipmates and I went through, that was one of the hardest things to carry.<br /><span></span>All I ever wanted was acknowledgment of the job we did and the conditions we served under. The things we experienced were real, and the wounds we carried home were real. I refused to let the sacrifices of my shipmates be dismissed or forgotten. I owed it to them to keep fighting until the truth was recognized.<br /><span></span>This battle lasted fourteen years.<br /><span></span>In many ways, I believe my PTSD became worse because of the fight itself. Every appeal meant reopening the same memories and reliving the same events over and over again. Each denial meant more waiting, more paperwork, and more time spent trying to prove something that should never have needed proving.<br /><span></span>What finally brought this journey home for me was the approval of Combat-Related Special Compensation. That was the moment when everything became real. It was not about the money. It was about acceptance. It was the first time the system formally acknowledged that the injuries I carried home from combat were connected to the service my shipmates and I performed.<br /><span></span>More than anything, what I feel today is relief.<br /><span></span>Relief that this fight is finally over. Relief that the record now reflects the truth. Relief that I can finally close a chapter of my life that lasted more than 5,000 days.<br /><span></span>The only thing that could make the story more complete would be if Congress passes the Major Richard Star Act and restores the retirement pay that medically retired combat veterans like me earned through our service. The Hagel Memo requires that the Board </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; font-weight: bold;">give liberal consideration to</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; font-weight: bold;"> Mr. Little&rsquo;s request for change to permanent disability retirement due to his PTSD.</span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> 25 August 2017</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Department of Defense Memorandum providing Clarifying Guidance to Military Discharge Review Boards and Boards for Correction of Military/Naval Records Considering Requests by Veterans for Modification of the Discharge Due to Mental Health Conditions, Sexual Assault, or Sexual Harassment (&ldquo;Clarifying Guidance&rdquo;) provides that veterans discharged prior to implementation of heightened screening measures &ldquo;may be the victim of injustice because commanders fully informed of such conditions and causal relationships today may opt for a less prejudicial discharge to ensure the veteran retains certain benefits, such as medical care.&rdquo;</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  The memorandum notes </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">that external sources of evidence to include lay statements from family and peers are to be considered with equal weight, and specifies that liberal consideration be given to veterans petitioning for discharge relief when the application is based in whole or in part on matters relating to mental health conditions including PTSD. </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Mr. Little went through the IDES process before the Navy had the deeper understanding of PTSD that it does today. </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">In his submissions to the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Physical Evaluation Board (</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">PEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">)</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> and </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">BCNR</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, Mr. Little provided numerous personal statements as well as lay statements of others with evidence that has been routinely ignored.  We ask that the Board review that evidence </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">along with new evidence offered in this brief</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> with the liberal consideration required by the Clarifying Guidance. </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; font-weight: bold;">2. </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; font-weight: bold;">Mr. Little&rsquo;s PTSD and Depressive Disorder are combat-related injuries per </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; font-weight: bold;">SECNAVINST</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; font-weight: bold;"> 1850.4E.</span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">26 U.S.C. 104(b)(3) defines a combat-related injury as personal injury or sickness </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">incurred as the result of armed conflict, amongst other things. </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">here must be a definite causal relationship between the armed conflict and the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">resulting unfitting disability, specifying that a</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">rmed conflict includes a war, expedition, occupation of an area or territory, battle, skirmish, raid, invasion, rebellion, insurrection, guerrilla action, riot, or any other </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">action in which service members are engaged with a hostile or belligerent nation, faction, force, or terrorists.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">,</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> Iraq in 2008 and Afghanistan in 2009. </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">His resultant PTSD and Depressive Disorder </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">are</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">,</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> therefor</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">e,</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">combat-</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">related injuries.  </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> is a preponderance of the evidence.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">As we will review below, Mr. Little has exceeded th</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">is</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">standard</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> by providing substantial evidence </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">of how his combat-related PTSD and Depressive Disorder</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> rendered him unfit for continued duty</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> and qualify him for permanent disability retirement</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.  </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">In his </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">arduous journey to receive the permanent disability retirement he is owed, Mr. Little has suffered </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">numerous </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">injustice</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">s</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, beginning with having to repeatedly try to convince those who are meant to help him </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">that he is telling the truth.  He is hardly the first service member to be unable to disclose certain information about his deployments.  It is egregious that people ranging from medical personnel to this Board itself have called into question his</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">integrity time and again.  We ask that while reviewing this request</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, the Board strive to view this case as one of a combat </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">veteran</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> with debilitating invisi</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">ble wounds of war who was abandoned by his command, ignored by the presiding members of a Formal PEB hearing, and ultimately let down by the service to which he gave everything. </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">ARGUMENT</span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px;">I. </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">The </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">PEB</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">committed an error by failing to find that Mr. Little qualified for permanent disability retirement or, in the alternative, placing him on the temporary disability retirement list.</span><br /><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Mr. Little met the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">criteria for unfitness at the time of his PEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">in 2016</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.  Per </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">SECNAVIN</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">ST</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> 1850.4E, t</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">he sole standard to be used in making determinations of physical disability as a basis for retirement or separation is unfitness to perform the duties of office, grade, rank or rating because of disease or injury incurred or aggravated while entitled to basic pay.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">It further </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">instructs that &ldquo;</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">If a member's nature of disability does not meet the criteria for permanent retirement set forth in paragraph 3705 and 10 </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">U.S.C</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">1202, place the member on the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">TDRL</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> in accordance with 10 U.S.C. 1202 or 1205, as appropriate. Also, place members whose disabilities are unstable on the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">TDRL</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, if otherwise qualified.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">&rdquo;</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"></span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Both the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Informal PEB (</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">IPEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">)</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">and Formal PEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">(</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">FPEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">)</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">concluded that Mr. Little was fit to </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">continue on</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> active duty</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">because his</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> PTSD</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> was not severe enough</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">. Even if these boards </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">had adequate evidence to support a finding that Mr. Little did not qualify for permanent disability retirement, he certainly should have been placed on the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">TDRL</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> rather than </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">found</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> fit and left in limbo </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">i</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">n the IRR</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The existence of Mr. Little&rsquo;s PTSD and Depressive Disorder were never in contention despite some apparent confusion by the members of the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">FPEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.  The worst-</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">case scenario for Mr. Little should have been a determination that his PTSD and Depressive Disorder, along with Migraines, </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">were not of a permanent and stable nature per</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">&sect;3706.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  It would not have been wholly unfathomable, as with many cases involving mental health, for the Board to have considered his conditions potentially &ldquo;unstable when the preponderance of medical evidence establishes that accepted medical principles indicates the severity of the condition will change within the next 5 years so as to result in an increase or decrease of the disability rating percentage or a finding of Fit.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">&rdquo;</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The complete disregard of substantial evidence establishing a severe case of PTSD and Depressive Disorder </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">robbed Mr. Little of his ability to serve and a finding of fitness for duty </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">are</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, on the other hand, quite difficult to comprehend.</span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px;">II. </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">The </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">Informal and </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">Formal PEB</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">s</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">erred in </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">ignor</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">ing</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";"> the great weight of the evidence presented by the MEB.</span><br /><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The MEB </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Narrative Summary (</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">NARSUM</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">)</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> was filled with more than enough evidence that Mr. Little met </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">and exceeded </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">the above criteria.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Unlike </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">the members of the Formal PEB, the ME</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">B consists</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> of </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">two or more physicians, one of whom &ldquo;must have detailed knowledge of the standards </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">pertaining to medical fitness </span><span style="line-height: 21.600000381469727px; font-style: italic; font-family: "Times New Roman";">retention standards</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, the disposition of patients, and disability separation processing.&rdquo;</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Furthermore, in cases such as Mr. Little&rsquo;s involving behavioral health, the MEB must include a thorough behavioral health diagnosis and the signature of at least one psychiatrist or psychologist with a doctorate in psychology.</span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The reasoning and conclusions of the MEB </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">were</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, therefore,</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">by e</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">xperts</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> qualified in assessing PTSD and Depressive Disorder</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, unlike</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> those who made up the Formal PEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, amongst whom the only medical professional</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> was a Navy occupational doctor.  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">NARSUM</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> in reviewing Mr. Little&rsquo;s case and keep in mind that it was written with highly specialized knowledge of his conditions and their effects. </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px;">a. </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">The </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">FPEB</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">erred in not complying with the requirements of </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">DODI 1332.18 to consider both of Mr. Little&rsquo;s behavioral health diagnoses of PTSD and Depressive Disorder</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">,</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";"> and their combined effects on his fitness for duty</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">. </span><br /><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Per DODI 1332.18, the MEB documents whether the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">s</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">ervice member has a </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">medical condition</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">s</span><span style="line-height: 21.600000381469727px; font-style: italic; font-family: "Times New Roman";">, whether singularly, collectively or through combined effect, </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">that will prevent </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">him</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> from reasonably performing the duties of </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">his</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> office, grade, rank, or rating. If the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">s</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">ervice member cannot perform the duties of his office, grade, rank, or rating</span><span style="line-height: 21.600000381469727px; font-style: italic; font-family: "Times New Roman";">, </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">the MEB refers the case to the PEB.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  It is our contention that in failing to consider Depressive Disorder, the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">FPEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> did not meet this requirement to consider the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; text-decoration: underline;">combined</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> and chronic effects of PTSD and Depressive Disorder.  While we do not at all concede the point that Mr. Little&rsquo;s PTSD is not on its own unfitting, even if the PEB came to that conclusion they failed to consider that the combined effects of both PTSD and Depressive Disorder have unquestionably left Mr. Little unable to perform the duties of an ABH2.  </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The MEB concluded that the &ldquo;chronic nature&rdquo; of Mr. Little&rsquo;s PTSD and Depressive Disorder made it unlikely that he would improve sufficiently in the next five years to meet retention standards.  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">They rated both PTSD and Depressive Disorder individually as diagnoses preventing Mr. Little from meeting retention standards in accordance with </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">SECNAVINST</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> 1850.4E.  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The PEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, however,</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> did not even consider Mr. Little&rsquo;s Depressive Disorder when making its determination, instead on</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">ly assessing PTSD and Migraines.  The MEB assessed Mr. Little for Migraines and Chronic Lumbar Strain in addition to PTSD and Depressive </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Disorder, but</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">did not rate either as unfitting.  Furthermore, </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">neither of the latter were mentioned in the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">IPEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> findings making it</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> wholly u</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">nclear why </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">FPEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">failed to even mention</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> Depressive Disorder and instead chose to focus on Migraines</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">. </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">DODI 1332.18 identifies relevant evidence in assessing fitness of a member referred for a chronic condition, stating &ldquo;[W]hen a </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">s</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">ervice member is referred for disability evaluation under circumstances other than as described in paragraph </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">3.a</span><span style="line-height: 21.600000381469727px; font-style: italic; font-family: "Times New Roman"; color: rgb(255, 0, 0);">. </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">of this appendix, an evaluation of the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">s</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">ervice member&rsquo;s performance of duty by supervisors may more accurately reflect the capacity to perform. Supervisors may include letters, efficiency reports, credential reports, status of physician medical privileges, or personal </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">testimony of the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">s</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">ervice member&rsquo;s performance of duty to provide evidence of the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">s</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">ervice member&rsquo;s ability to perform his or her duties.&rdquo;</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">To clarify, Mr. Little was referred for a chronic condition, as the MEB repeatedly references in the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">NARSUM</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.  This means that </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">even if the PEB concluded that the medical evaluation alone did not justify a finding of unfitness and permanent disability retirement, they were bound to consider additional forms of evidence as listed in section b. In Mr. Little&rsquo;s case, it appears that the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">FPEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> members misunderstood or simply missed a great deal of evidence supporting an unfitness determination </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">in the form of supervisor letters and oral testimony, as well as the member&rsquo;s own personal letters and testimony. </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px;">b. </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">Mr. Little&rsquo;s </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">NARSUM</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";"> was inadequate and therefor did not serve </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">its intended evidentiary purpose</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";"> in a determination of unfitness.</span><br /><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Mr. Little suffered an injustice at this point as his Non-Medical Assessment (NMA) should have been a crucial piece of evidence to be considered in determining his unfitness. Per </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">SECNAVINST</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> 1850.4E, &ldquo;[T]his document is crucial in summarizing the member&rsquo;s limitations from the perspective of the commanding officer. Given the disability evaluation system&rsquo;s emphasis on performance, the NMA&rsquo;s ability to highlight the sailor or Marine&rsquo;s ability/inability to execute duties as required of his/her rating/rank and the reality of their contribution is critical in portraying a service member&rsquo;s limitations. Capturing the command&rsquo;s observations as to how the service member&rsquo;s impairments have or have not impacted upon the member&rsquo;s ability to function within the command through concise and succinct statements greatly assists the voting members in determining the Fit/Unfit potential of the member.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">&rdquo;</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"></span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Mr. Little&rsquo;s NMA was written by a commanding officer who, by his own admission, had &ldquo;not had the pleasure of getting to know </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">ABH2 Little or seeing his work ethic&rdquo; and based his entire opinion in what would form a crucial piece of evidence upon Mr. Little&rsquo;s service record.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">This CO does </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">nonetheless state that Mr. Little</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> &ldquo;struggled to adapt to being back home due to multiple exposures to invisible wounds,&rdquo; conceding that Mr. Little was no longer the &ldquo;great sailor with wonderful potential prior to his injuries.&rdquo;  The issue arises with the recommendation for retention, which was based on Mr. Little&rsquo;s own confusion surrounding his fitness and abilities at that point.  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Mr. Little believed he could remain in the Navy because he thought that was what he was supposed to say and do as a good sailor, so that is what he told his CO which was the basis of the CO&rsquo;s recommendation. </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Mr. Little</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, however, was clearly not competent to</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> diagnose his own mental health disabilities of PTSD and Depressive Disorder, and </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">he </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">was at that time navigating acceptance of the fact that </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">he was no longer the man or sailor he was before his multiple tours of duty.  It was the Navy&rsquo;s duty to identify his unfitness for duty and afford him the mental health assistance he required.  </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px;">c. </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">The </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">PEB </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">erred in its </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">findings of fitness </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">because it ignored</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";"> the </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">MEB&rsquo;s</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";"> conclusions based on the </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">VA rating criteria.</span><br /><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">MEB&rsquo;s</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">supporting evidence for finding PTSD and Depressive Disorder to be unfitting conditions, in combination with the 09 APR 2014 VA Disability Rating Decision </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">awarding</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">a 70% rating for PTSD and Depressive Disorder, was </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">ample proof for the PEB to grant Mr. Little permanent disability retirement</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">,</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> or at the very least placement on </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">TDRL</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">. </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">While the PEB is not bound by the VA Rating Decisions, i</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">t is instructed to use the VA S</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">ch</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">e</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">dule for Rating Disabilities (</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">VASRD</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">) per </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">SECANVINST</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> 1850.4E &sect;3802 once a member is </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">found unfit.  Since a member such as Mr. Little would be unfit should his injuries leave him 30% disabled or more per the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">VASRD</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> guidelines, it is especially difficult to comprehend how </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">the he</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> was found fit for duty at the PEB level. </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">VASRD</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> diagnostic requirements for PTSD include (1) a stressor (2) intrusive recollection (3) avoidance (4) </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">negative alternations in cognition and mood (5) hyper-arousal (6) duration (7) functional significance. </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The MEB </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">address</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">ed the symptoms in the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">NARSUM</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> based upon a VA </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Disability Benefits Questionnaire (</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">DBQ</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">)</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> for PSYCH PTSD Exam dated 29 SEP 2015 diagnosing Mr. Little with PTSD and Unspecified Depressive Disorder.</span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">(1) Stressor:  The MEB </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">directly attributed Mr. Little&rsquo;s </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">PTSD</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> to </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">his experiences of </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">&ldquo;moral injury, physical and mental abuse</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> and feared for his life on a daily basis</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">&rdquo;</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> during his 2008 deployment to Camp </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Bucca</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, Iraq. </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">His reports of not only witnessing riots but being </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">in the midst of</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> them have been detailed repeatedly in his medical notes as well as his personal statements.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">(2) Intrusive Reminders: The MEB mentioned triggers leading to intrusive reminders </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">about his deployments, specifically the smell of feces and hearing people speaking Arabic.  The latter was sadly confirmed by M</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">r.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> Little&rsquo;s witnessing of a car crash when the driver began speaking Arabic and he </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">experienced a full-blown PTSD flashback panic attack that required hospitalization.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The MEB also noted nightmares about his deployment experiences.  </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">(3) Avoidance: </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The MEB mentions </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">avoidance of situations such as crowds</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.</span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">(4) Negative alterations in cognition and mood:</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> The MEB references that Mr. Little reported suicidal thoughts to his Naval Reserve command in 2010.  In lieu of receiving appropriate assistance and </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">(5) Hyper-arousal:</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> The MEB mentions hypervigilance &ldquo;such that he reported feeling watchful and easily startled, particularly by loud noises.&rdquo;</span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">(6) Duration:</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> At the time of the PEB, Mr. Little&rsquo;s PTSD symptoms had persisted and worsened over the course of six years.  The </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">VASRD</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> requires presence of symptoms for more than one month. </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">(7) Functional Significance:</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  The MEB </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">made it very clear that &ldquo;Despite multi-modal therapies his PTSD and depression prevent him from performing the requirements of his rank and Service.&rdquo;</span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> and more than establish a PTSD disability rating of far greater than 30% to warrant a finding of unfitness.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  Again, even if both levels of the PEB agreed that Mr. Little did not yet meet that requirement for a finding of unfitness, the above evidence unequivocally established a case of PTSD that at the very least required placement on </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">TDRL</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">for a five-</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">year period of monitoring symptoms. </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">To be clear, this would contradict the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">MEB&rsquo;s</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> conclusion that the &ldquo;chronic recurrent nature&rdquo; of Mr. Little&rsquo;s symptoms made it &ldquo;unlikely that the SM will improve sufficiently in the next 5 years to meet retention standards.&rdquo;</span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px;">III. </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">The Formal PEB Rationale </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">erred in </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">grossly misc</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">onstru</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">ing</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">the evidence that was available at the time. </span><br /><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">In its analysis, the Formal </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">PEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> question</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">ed</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> and downplay</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">ed</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> the horrific traumas Mr. Little endured on his deployments. </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Formal PEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> state</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">d</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> Mr. Little &ldquo;witnessed his colleagues treat detainees poorly, and he also suffered discrimination and isolation from his colleagues as he was one of the few Sailors in an Army unit.&rdquo;</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">This, however, was an </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">unjust </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">understatement</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> and contained factual errors</span><span style="line-height: 21.600000381469727px;  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">His command</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> in Camp </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Bucca</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> was relieved because of abuse </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">o</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">f detainees</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, and at the time of the hearing Mr. Little testified that two of his shipmates were still in prison and two were dishonorably discharged</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">as a result of</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">detainee abuse</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.  Mr. Little was not discriminated against because he was a Sailor serving in an Army unit, but rather because he attempted to speak out against this criminal treatment of detainees. </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">This was a factual inaccuracy by the Formal PEB.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"></span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Further, o</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">n his second tour</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, the one in Afghanistan</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, he was completely alienated by his peers for nine months </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; text-decoration: underline;">due to his position</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> (not because he was a sailor in an Army unit)</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, which required him to determine punishments for detainees.  When detainees offered intelligence to avoid punishment, Mr. Little would be forced</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> by his superiors</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> to let them walk free with no punishment.  In oral testimony, he cited having to look a female peer in the face after an </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">assault</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> by a detainee left her with 18 stitches across her head </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">and tell her that her attacker would not be punished.  The mental distress of doing this once</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">,</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> let alone</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">repeatedly</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> for nine months</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">,</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">was</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">astronomical and</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">FPEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> failed to mention this at all and mischaracterized it in its attempt to summarize the evidence</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.  </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Instead</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, the Formal PEB cit</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">e</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">d</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> a Post-Deployment Survey of 20 APR 2009 in which Mr. Little indicated </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">&ldquo;That he did not experience nightmares, difficulty sleeping, inappropriate anger, feelings of depression, or anxiety since returning CONUS.&rdquo;</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  This demonstrates nothing in terms of Mr. Little&rsquo;s </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">PTSD, but</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> does demonstrate the Navy&rsquo;s reprehensible handling of mental health at the time.  This survey was given </span><span style="line-height: 21.600000381469727px; font-style: italic; font-family: "Times New Roman"; text-decoration: underline;">one month after</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> Mr. Little returned from his tour in Camp </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Bucca</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.  Neither </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">VASRD</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> nor the DSM manuals</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> require that symptoms of PTSD be present one month after trauma exposure.  In fact, it is exceedingly common for </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">onset of symptoms to be significantly delayed.  This makes this particular argument of the Formal PEB completely </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">moot, and</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">is an excellent reminder of why we now have the Hagel Memo to remind reviewing agencies to consider petitions involving mental health with compassion and a deeper understanding for the chaotic nature of these invisible wounds.  Notably, the Formal PEB later cites another mental health survey given on 20 OCT 2009 prior to Mr. Little&rsquo;s second IA tour, pointing erroneously to the fact that Mr. Little </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">&ldquo;</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">had not received any mental health counseling in the past 3 years, taken any mental health med</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">ications in the last 3 years, and did not have any thoughts of suicide, homicide, or hallucinations.&rdquo;</span><span style="line-height: 8.399999618530273px; font-family: "Times New Roman"; vertical-align: super; font-size: 7px;"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> This is, again, deeply misguided logic, as Mr. Little had only been through his traumatic experience in Iraq within the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">preceding</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> year.   Looking to the past three years as evidence of a lack of PTSD symptomology really has no bearing</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">because over those three years he was not yet traumatized because he had not yet been to Iraq, then was in Iraq, then was merely months out of Iraq</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.  </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">FPEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> goes on to </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">unjustly</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> question the timeline of Mr. Little&rsquo;s Iraq deployment with &ldquo;known events that have been document</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">ed</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> in numerous open sources</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">,</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">&rdquo;</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> but does not cite those sources.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  This has already been addressed eloquently in the Petition for Relief dated 1 JUN 2016 and frankly is so </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">plainly erroneous and </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">unjusty</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> that we will refrain from addressing it at length yet again.  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The Hagel Memo requires </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Mr. Little&rsquo;s personal </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">accounts of what he experienced in Iraq and Afghanistan, which have been validated by those who served with him in peer statements and in the media, to be taken as true.  </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px;">IV. </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">The Formal PEB </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">erred in factually </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">misrepresent</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">ing</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";"> oral testimony</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";"> in its Rationale.</span><br /><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Possibly the most </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">erroneous</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> misrepresentation made by the Formal PEB is the assertion that Mr. Little&rsquo;s supervisors and peers testified that his civilian work performance was not only </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">adequate enough</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> to suggest retention in the Navy</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">,</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> but that he was thriving</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, because the testimony was </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; text-decoration: underline;">exactly the opposite</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.  </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">PEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> cites RADM Hall and </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">MCPO</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Niblack</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> as singing Mr. Little&rsquo;s praises, while this could not be further from the points each tried to make.  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">We have included compact discs with recordings as well as a transcript </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">of the oral proceedings and beseech the Board to review them.  We believe that the contents are crucial evidence proving the error and injustice made in denying Mr. Little permanent disability retirement.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  The following evidence is taken from the recordings.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"></span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">MCPO</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">quite obvious</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> to him that Mr. Little&rsquo;s IA tour had affected him, and that he had to work very hard to earn Mr. Little&rsquo;s trust.  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">MCPO</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Niblack</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> stated that </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Mr. Little</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">really only</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> began to open up upon learning that </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Niblack</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> himself had been to Afghanistan.  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">MCPO</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Niblack</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> did state that it was difficult to discuss his friend&rsquo;s </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">shortcomings in public, but overall painted a very clear picture of how deeply Mr. Little suffers daily. </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Regarding symptoms of PTSD, </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">MCPO</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Niblack</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> stated that Mr. Little started out </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">in his civilian job</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> with great enthusiasm for his work</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">,</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> but </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">all of a sudden</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> began having interpersonal troubles and was unable to do his job, leading to </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">his</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> resignation.  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Niblack</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">reported fielding many complaint calls from civilians regarding Mr. </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Little, and</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> said that he tries to diffuse the friction as best possible.  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">MCPO</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Niblack</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> also shared with the Board that there are times when Mr. Little could not come to work because of headaches, nightmares, sleep deprivation, and so on, </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">and also</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">testified to having taken Mr. Little to the hospital.  He poignantly observed that it is very difficult for Mr. Little to not be at his best and that he attempts to hide it by not coming to work, paralleling this to the lengths to which Mr. Little goes </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">in order to</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">hide </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">his symptoms from his wife. When asked, </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">MCPO</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Niblack</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> stated he would neither take Mr. Little to Afghanistan no</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">r</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> have him on a flight deck, aptly describing aviation as a &ldquo;zero defect game.&rdquo;</span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The Board similarly misrepresented the testimony of RADM Hall, saying that he &ldquo;portrayed the member as </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; text-decoration: underline;">extremely capable</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.&rdquo;</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> RADM Hall, an aviator and Air Boss, began his testimony by describing the duties of an ABH2</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.  He described them as leaders of the flight deck in charge of the safe launch and landing of </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">aircraft, and</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> attested that the job requires 100</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">%</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> attention to detail, environment, and surroundings at all times during a 14-hour day. He testified that even a headache would be a tremendous hindrance, affecting attention, vision, response time, and length of time one could spend on the flight deck.  He stated at the end of testimony that Mr. Little </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; text-decoration: underline;">did not belong on a flight deck</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.  </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">RADM Hall went on to describe Mr. Little&rsquo;s PTSD, saying his symptoms were very consistent.  He stated that triggering events could be anything from work to family to nothing whatsoever</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, and upon looking over at Mr. Little said that he could see the warning signs in him at </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">that</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">very moment</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> as Mr. Little fidgeted and attempted to sternly focus.  Perhaps most importantly, RADM Hall made it very clear that he had no problem making accommodations for Mr. Little in their working relationship, saying that his work performance was based not on hours in an office but on Mr. Little&rsquo;s interactions </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">with Congress</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.  </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">This is an extremely important point</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">. </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Even if</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> Mr. Little were still able to hold this civilian job, it had no relevance as to whether he could continue to perform the </span><span style="line-height: 21.600000381469727px; font-style: italic; font-family: "Times New Roman"; text-decoration: underline;">duties of an ABH2</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">. </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">There is no place in the Evaluation and Counseling forms where a sailor is ranked based on their ability to make interpersonal connections.  They are expected to show up on time every day and do their job.  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">RADM Hall made i</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">t</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> exceedingly clear that Mr. Little was routinely </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">accommodated</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> and staff was educated on his condition to make allowances for him.  Before ending his testimony, RADM Hall addressed the question about a supportive letter he had previously written, saying that there was a time </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">difference</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> and that </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Mr. Little was no longer the person described therein.  </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The overall impression left by </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">MCPO</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Niblack</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> and RADM Hall, as well as every other person testifying was that Mr. Little was a </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; text-decoration: underline;">formerly</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> excellent worker who </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; text-decoration: underline;">currently</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> struggled.  He was described as often absent and unpredictable.  The most confusing part of this case seems to be the fact that Mr. Little tried valiantly for years to push through his PTSD symptoms rather than just succumbing to their effects.  It seems that </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">from the PEB level onwards, this has been held against </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">him.  At times it has essentially been suggested that he should have recognized his symptoms promptly and identified his disability himself, while this duty in fact lies with the Navy.  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The standard to be applied here is that of fitness or unfitness for duty.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; text-decoration: underline;">None of the testimony presented suggested that Mr. Little came anywhere close to being </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; text-decoration: underline;">capable of the prima</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; text-decoration: underline;">ry duties of an ABH2.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">FPEB&rsquo;s</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> finding to the contrary was clearly erroneous. </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The testimony </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">did</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> however, make it very clear that Mr. Little&rsquo;s PTSD and Depressive Disorder made him unable to continue the reasonable performance of duties per </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">SECNAVINST</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> 1850.4E &sect; 3304. </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The testimony of Mr. Little&rsquo;s wife, Elizabeth Ann Little, was wildly misrepresented in the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">FPEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> decision.  To start, there is no burden on Mrs. Little to professionally diagnose each symptom of PTS in he</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">r husband.  In its Rationale, the Formal PEB describes her testimony as &ldquo;particularly informative&rdquo; as she &ldquo;witnesses the member in a wider range of environments than his coworkers.&rdquo;</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> Mrs. Little has written a </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; text-decoration: underline;">new statement</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> addressing this an</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">d</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> other issues with the Board&rsquo;s characterization of her testimony.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">She reiterates in her letter that, as stated in oral proceedings, she works long hours as a corpsman, leaving by 0530 and does not return until around 1700 in the evening.  This means that, contrary to the Board&rsquo;s statement, she does </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; text-decoration: underline;">not</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> witness him in a wider range of environments than his co-workers.  As she aptly points out, this case is to determine Mr. Little&rsquo;s fitness for duty</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, so there is nothing more relevant than the observations of those co-workers and their impressions of his ability to function in a </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; text-decoration: underline;">military</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; text-decoration: underline;">environment</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.  The most &ldquo;particularly informative&rdquo; testimony and evidence is that which supports the conclusion that his PTSD and Depressive Disorder have left him unable to fulfill his duties as an ABH2.  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Mrs. Little also contradicts the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">FPEB&rsquo;s</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> suggestion that because she could not explicitly remember Mr. Little having a nightmare, she does not believe he suffers from nightmares.  In testimony, she reported being a heavy sleeper and not recalling her husband waking her to tell her about a nightmare.  This is consistent with their relationship as reported to the Board </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">fairly openly</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> &ndash; Mrs. Little is aware that Mr. Little takes extreme measures to </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">shield her from how greatly he suffers, and he himself admits to not sharing much with her at all.  This is common in those with PTSD and of course cannot be held against him in the decision of fitness for duty.  The severity of his symptoms is made clear by plenty of other forms of evidence, and the obsession with </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">whether or not</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> his wife remembers nightmares i</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">s</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> mystifying.  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Nightmares are far from the only symptom of PTSD,</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> and as made clear previously in this brief, Mr. Little displayed and currently displays symptoms in all categories of the diagnostic criteria. </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px;">V. </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">The Formal PEB&rsquo;s characterization of Mr. Little&rsquo;s ability to maintain civilian employment </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">was erroneous because it did not</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";"> appl</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">y</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";"> standards for making an unfitness determination per </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">SECNAVINST</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";"> 1850.4E</span><br /><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The findings of the Informal and Formal PEBs (as well as subsequent findings by the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">CORB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> and </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">BCNR</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">) place great weight on Mr. Little&rsquo;s civilian employment.  At the time of the PEB, Mr. Little worked with great a</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">ccommodation as a Legislative Director and Registered Lobbyist for the Association of the United States Navy (AUSN). As </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">written above, the testimonies of RADM Hall and </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">MCPO</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Niblack</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, both of whom worked with him at the time, made it very clear that Mr. Little&rsquo;s employment </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; text-decoration: underline;">could not be likened to</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> the duties of an ABH2</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, it was therefore erroneous for the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">FPEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> to rely on it</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.  </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">SECNAVINST</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> 1850.4E directs the PEB to determine whether the member can reasonably perform his or her duties when</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> making a finding of unfitness: &ldquo;The </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">sole standard</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> to be used in making determinations of physical disability as a basis for retirement or separation is Unfitness to perform the duties of office, grade, rank or rating because of disease or injury incurred or aggravated while entitled to basic pay. Each case is considered by relating the nature and degree of physical disability of the member to the requirements and duties that member may reasonably be expected to perform in his or her office, grade, rank or rating.&rdquo;</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  This determination is to be based upon a preponderance of the evidence.</span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Mr. Little&rsquo;s </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">civilian </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">employment and his </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">volunteer work assisting veterans understand potential available health benefits cannot </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">justly</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> outweigh the great </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">volume</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> of evidence proving his severely disabling combat-related PTSD and Depressive Disorder</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">prevented him from functioning as an ABH2 &ndash; two completely different roles</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.  In applying the &ldquo;sole standard&rdquo; above, the PEB had a duty to determine whether Mr. Little could perform his duties as an ABH2.  The oral testimonies made it clear that he could not.  RADM Hall was adamant that while he respected Mr. Little and wanted him to succeed, that was only possible with incredible accommodation for his disabilities. </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">There is no flight deck in the world where an ABH2 can </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">work</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> from home.  The oral testimony of Christopher Slawinski, a colleague at AUSN and Naval veteran with experience on the flight deck, </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">addressed the fact that Mr. Little&rsquo;s tendency to be triggered easily leading to interpersonal issues would make even a classroom drilling situation an impossibility.</span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">The PEB had a duty to determine whether Mr. Little could serve in the Navy, not to </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">dissect</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> evidence </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">in </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">an </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">attempt to</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> prove that he was able to hold civilian employment as a </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">proxy</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> to military service.  There was no parallel between the work Mr. Little was doing at the time and </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">the duties of an ABH2.  Placing any weight on this ignored the clear standards set out by </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">SECNAVINST</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">1850.4E and violated the Navy&rsquo;s duty to make an unfitness determination in the best interest of the health and safety of not only Mr. Little but every other sailor on the flight deck.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"></span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Mrs. Little&rsquo;s statement additionally establishes that Mr. Little&rsquo;s current symptomology meets and most likely exceeds the 30% disabling threshold require</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">d for medical retirement</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, with specific regard to his ability to </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">hold any form of</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> standard</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> employment</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">She writes that even with the health improvements from </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Ketamine and </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">SGB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> treatments, Mr. Little is extremely limited in terms of employment.  Despite pursuing treatment continuously since the time of his PEB, Mr. Little is now confined to working from home exclusively.  </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">We ask that the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">BCNR</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> keep this in mind when reviewing </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">t</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">his case:  Mr. Little was </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">a</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> sailor who truly and deeply loved serving his country in the United States Navy, and it took the cripplingly debilitating effects of his PTSD and Depressive Disorder to force him into the realization that he could no longer do so.  The day this man admitted to himself that he could no longer serve on a flight deck was </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">one of the worst of his life, which is </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">notable</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> given what he has been through.  The insinuations made during the Formal </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">PEB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> hearing that perhaps he was only bringing up mental health symptoms to avoid discharge for weight failure were some of the most egregious made throughout this case.  As Mr. Little corrected that </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">particular board</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> member, he had been attempting </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">to gain recognition of his PTSD and Depressive Disorder from the Navy long before he fell out of weight standards.  An arduous course of medication trials in attempt</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">s</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> to </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">quell the symptoms left him struggling with weight despite extreme dieting and exercise regimens.  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Mr. Little made every attempt to continue serving all while fighting for his life, and now deserves at the very least recognition of the PTSD and Depressive Disorder his service left him with.  </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px;">VI. </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">Following the failures of the Formal PEB, Mr. Little suffered subsequent error and injustice at the </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">BCNR</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";"> and </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">CORB</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";"> levels. </span><br /><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Both the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">CORB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> and </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">BCNR</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> decisions overlook the standard to be applied in a determination of fitness, which is an inability to perform the duties of his/her office, grade, rank, or rating.  Both rely on Mr. Little&rsquo;s civilian employment, in a misguided attempt to create a parallel between this and continued military service.  Even the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">CORB</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> rationale that Mr. Little was &ldquo;capable of serving in a reserve shore command that involves clerical duties&rdquo; is illogical, as at the time Mr. Little was </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">given incredible accommodations to manage his debilitating PTSD and Depressive Disorder</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, including being allowed to work from home</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">. </span><br /><span></span><span style="line-height: 21.600000381469727px; padding-left: 36px;">&#8203;</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman"; color: rgb(34, 34, 34);"></span><br /><span></span><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px;">VII. </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">If Mr. Little had been appropriately transferred to the </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">TDRL</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">, his five years would be at an </span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";">end</span><span style="line-height: 21.600000381469727px; font-weight: bold; font-family: "Times New Roman";"> and he would undeniably be found unfit for duty. </span><br /><span style="line-height: 21.600000381469727px;"> </span><br /><span></span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">As aforementioned, Mr. Little should have been transferred to the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">TDRL</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> rather than in</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">to the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">IRR</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> per </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">SECNAVINST</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> 1850.4E.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">If Mr. Little had been placed on the </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">TDRL</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> following his PEB, the five years of monitoring his condition would be expired. </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">His condition has </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">worsened</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> over that period.  </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Despite pursuing the most effective treatment options over those five years, he is no longer able to work </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">except from home</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">  He has also been unable to continue his nonprofit work helping his fellow veterans understand health b</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">enefits available to them.  He has been lucky to find a form of employment that allows him to continue working exclusively from home</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, but his disabilities are at this point so severe that even this is done with very generous allowances for time off and medical care.  Mr. Little addresses this in a new statement submitted along with this request for reconsideration.</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";"> </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">Overall, he is given 280 hours (35 days) a year </span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">for medical appointments alone.  This along with the incredible flexibility he is given in his daily schedule to accommodate everything from sleep disturbances to panic attacks far exceed any accommodations that would be provided were he still serving in the Navy today</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">, even if on shore duty</span><span style="line-height: 21.600000381469727px; font-family: "Times New Roman";">. Every day I have to go to the Navy admin office and work on paperwork, and this small town boy from Southern Illinois, gets to spend a few hours a day with this loud mouth girl from Yonkers!  </div>  <div>  <!--BLOG_SUMMARY_END--></div>  <div><div class="wsite-image wsite-image-border-none " style="padding-top:10px;padding-bottom:10px;margin-left:0;margin-right:0;text-align:center"> <a> <img src="https://www.michaeljosephlittle.com/uploads/2/9/6/4/29647347/p101.png" alt="Picture" style="width:auto;max-width:100%" /> </a> <div style="display:block;font-size:90%"></div> </div></div>  <div class="paragraph" style="text-align:left;">She was feisty! She loved to dance! She was LOUD! Oh gawd was she LOUD! She was caring! She was compassionate! She loved her daughters! She was my best friend! She loved to eat!<br /><br />So in an environment where we would be under an attack almost daily either from the Terrorist outside the gate or the ones inside; she was the one willing to listen to everyone, and be a buffer before we would implode.<br /><br />In some instances we were probably to blame for her PTSD because she was dealing with her own issues and here we were compounding on top of them. She was everyone&rsquo;s counselor that needed it, but I&rsquo;m not so sure we shared with her equally and let her tell us her issues and for that I&rsquo;ll always feel regretful.<br /><br />She was the first person I called after I reconnected with Elizabeth. She was my first call after we got engaged....she promised me she would come to the wedding. And the night she took her life we talked on FB messenger for several hours the night she promised me she was going to be ok. The last words she typed to me were &ldquo;Little! I&rsquo;m fine! PTSD is definitely real! It&rsquo;s a complete bitch! But I&rsquo;m fine Little! I can&rsquo;t wait to see the girls tomorrow! I love you Shipmate!&rdquo; She took her own life that night....the first of 2 females I served with to commit Suicide out of 15 total.<br /><br />Facebook graciously deleted my conversations a few years ago, and I can no longer read her funny comments to me or see her selfies she sent. My backpack with my external hard drive broke when I got to Atlanta...and of the two pictures we took together, I don&rsquo;t have them anymore.<br /><br />I follow her daughters on Social Media, because they were all she ever talked about, and it&rsquo;s bring me joy to see them so successful.<br /><br />I miss her every day. I can&rsquo;t help but to think about her everyday. She is one of the reasons I&rsquo;m going to fight the Navy! I was originally supposed to be an aviation machinist mate, and work on Jets....well that was great till we started to learn about Boyle and Newton, and others... they sent me to ABH School after that. Kinda sucked. Wouldn&rsquo;t have had to go to AC school if they would have just sent me to AD school first to discover I couldn&rsquo;t do it. But it was ok. ABH A School was amazing. I had so many great instructors there: Diaz, Shelley, King, Wallace and others I can&rsquo;t remember.<br /><br />I made friends with so many people I have on Facebook today; and so many I lost touch with because Facebook didn&rsquo;t exists back then.<br /><br />I was a great Sailor back there. Kept my room clean, was never late, loved to PT, and was just over all happy to be in a job that my great grandfather died doing during WWII when his ship was stuck by a Japanese Sub.<br /><br />I miss these days a lot! I wish these days would have reflected those nightmares I spent in Iraq and Afghanistan. I wish these carefree days of preparing to be a part of Naval Aviation is how I spent my career, but unfortunately they were not, and honestly I&rsquo;m glad my entire career was this carefree, I just wish the Navy and Army bad prepared me better to be more resilient to the job I was going to preform, much like they did during my time preparing to be an ABH.<br /><br />There is no reason why I am up at 3am other than I can&rsquo;t stop wondering what I&rsquo;ve done wrong to make the Navy want to accuse me so badly of being a liar about my service and failing to accept very clearly written medical evidence by their own doctors, as to why they owe me the relief of being Medically Retired.
